These Terms and Conditions ("Terms") govern access to and use of the website www.purecarehealthcare.ie (the "Website") and the healthcare recruitment services offered by Purecare Healthcare Limited ("Purecare", "we", "us", or "our"), a company registered in Ireland under company number 775954, with registered office at Suite 11088, 5 Fitzwilliam Square, Dublin 2, D02 R744.
By accessing the Website, submitting an application, registering as a candidate, or engaging Purecare as a client organization, you ("you", "your", or the "User") confirm that you accept and agree to be bound by these Terms, together with our Privacy Policy and Cookie Policy, each of which is incorporated into these Terms by reference. If you do not agree with any part of these Terms, you must not use the Website or our Services.
1. Definitions
- "Candidate" means any individual who registers with, applies through, or is placed by Purecare seeking employment opportunities.
- "Client" or "Employer" means any healthcare organization, hospital, clinic, care facility, or other entity that engages Purecare to source, screen, or place healthcare professionals.
- "Services" means Purecare's healthcare recruitment services, including sourcing, screening, interviewing, referencing, and placement of Candidates with Clients, whether on a permanent or temporary basis.
- "Content" means all text, graphics, logos, images, job listings, and other material appearing on the Website.
- "Personal Data" has the meaning given to it in the General Data Protection Regulation (EU) 2016/679 and the Irish Data Protection Act 2018.
2. Eligibility and Acceptance
The Website and Services are intended for use by individuals aged 18 or over and by organizations lawfully operating in the healthcare sector. By using the Website, you represent that you have the legal capacity to enter into a binding agreement with Purecare.
We reserve the right to refuse registration, restrict access, or terminate the account of any User who provides false, misleading, or incomplete information, or who otherwise breaches these Terms.
3. No Fees to Candidates
Purecare Healthcare Limited never charges Candidates a fee to register, apply for a role, or be placed with a client. Any communication requesting payment from a Candidate in connection with a job application, purporting to be from Purecare, is fraudulent. Genuine applications may only be submitted via www.Purecarehealthcare.ie /apply-for-jobs or by emailing info@Purecarehealthcare.com. If you believe you have been targeted by a recruitment scam using Purecare's name, please contact us immediately using the details in Section 15.
4. Use of the Website
You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, any third party. Prohibited uses include, without limitation:
- Submitting false, misleading, or fraudulent information in a job application or client enquiry;
- Attempting to gain unauthorized access to the Website, our servers, or any systems or networks connected to the Website;
- Using any automated system, including "robots", "spiders", or "offline readers", to access the Website in a manner that sends more request messages than a human can reasonably produce;
- Introducing viruses, trojans, worms, logic bombs, or other material that is malicious or technologically harmful;
- Copying, reproducing, republishing, or distributing Website Content for commercial purposes without our prior written consent;
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity.
We reserve the right to restrict or terminate your access to the Website, without notice, if we reasonably believe you have breached this Section.
5. Candidate Registration and Obligations
Candidates who register with Purecare agree to:
- Provide accurate, current, and complete information, including qualifications, work history, immunisation records, and identification/PPS details where required for compliance purposes;
- Promptly notify Purecare of any change in circumstances relevant to their registration or an active placement;
- Comply with all applicable professional, regulatory, and statutory requirements relevant to their role (including, where applicable, registration with NMBI, CORU, or other relevant regulatory bodies);
- Maintain the confidentiality of any login credentials associated with their account and notify Purecare immediately of any suspected unauthorized use.
Purecare undertakes to carry out reasonable and appropriate screening, vetting, and reference checks in accordance with applicable healthcare recruitment standards before making a placement, in line with our Privacy Policy.
6. Client Organisations
Clients engaging Purecare's Services agree to provide accurate information regarding role requirements, working conditions, and remuneration, and to treat Candidates introduced by Purecare fairly and in accordance with applicable Irish employment law.
The specific commercial terms of any placement, including fees, invoicing, payment terms, and rebate/replacement periods, will be set out in a separate written service agreement between Purecare and the Client. These Terms govern use of the Website; they do not replace or override any signed client services agreement, which shall take precedence in the event of any conflict.
7. Intellectual Property
All Content on the Website, including the Purecare name, logo, and "It's Not Just Staffing, It's Purecare" trademark, is the property of Purecare Healthcare Limited or its licensors and is protected by Irish and international copyright, trademark, and other intellectual property laws.
You may view, download, and print extracts from the Website for your own personal, non-commercial use, provided you do not modify the Content and you retain all copyright and proprietary notices. Any other use, including reproduction, republication, or distribution of Content, requires our prior written consent.
8. Third-Party Links
The Website may contain links to third-party websites, including social media platforms and job boards. These links are provided for convenience only. Purecare does not control and is not responsible for the content, privacy practices, or availability of any third-party website, and inclusion of a link does not imply endorsement.
9. Disclaimers
The Website and Services are provided on an "as is" and "as available" basis. While Purecare takes reasonable steps to ensure information on the Website is accurate and up to date, we make no warranty, express or implied, that the Website will be uninterrupted, timely, secure, or error-free, or that job listings, Candidate profiles, or other Content are accurate, complete, or current at all times.
Purecare exercises reasonable skill and care in sourcing and screening Candidates and Clients but does not guarantee any particular employment or business outcome, nor does it guarantee the ongoing suitability, conduct, or performance of any Candidate placed with a Client or any Client engaging a Candidate.
10. Limitation of Liability
To the fullest extent permitted by Irish law, Purecare shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with your use of the Website or Services.
Nothing in these Terms shall limit or exclude Purecare's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable Irish law.
Subject to the foregoing, Purecare's total aggregate liability arising out of or in connection with these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed €2000.
11. Indemnity
You agree to indemnify and hold harmless Purecare Healthcare Limited, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Website, or your violation of any applicable law or the rights of a third party.
12. Data Protection
Purecare processes Personal Data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Irish Data Protection Act 2018. Full details of what Personal Data we collect, how we use it, the legal bases we rely on, and your rights as a data subject are set out in our Privacy Policy and Cookie Policy, available at www.Purecarehealthcare.ie/privacy-policy and www.Purecarehealthcare.ie/cookie-policy respectively, both of which form part of these Terms.
13. Confidentiality
Any confidential information shared between Purecare, Candidates, and Clients in the course of the recruitment process, including but not limited to salary information, business requirements, and personal circumstances, shall be treated as confidential and shall not be disclosed to any third party except as necessary to deliver the Services or as required by law.
14. Termination
We reserve the right to suspend or terminate your access to the Website or Services at any time, with or without notice, if we reasonably believe you have breached these Terms, engaged in fraudulent activity, or where required to comply with a legal or regulatory obligation.
You may deactivate your Candidate account at any time by contacting us at info@Purecarehealthcare.ie. Deactivation does not affect any rights or obligations that accrued prior to termination.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Ireland. Any dispute arising out of or in connection with these Terms, including its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Ireland.
16. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our practices, services, or applicable law. The "Last updated" date at the top of this document indicates when it was last revised. Continued use of the Website following any changes constitutes your acceptance of the revised Terms. Registered Users will be notified of material changes by email where reasonably practicable.
17. General
- Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy (and, for Clients, any separate signed services agreement), constitute the entire agreement between you and Purecare regarding use of the Website.
- Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
- No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision.
- Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Purecare may assign these Terms in connection with a merger, acquisition, or sale of assets.
