We provide temporary healthcare staffing and recruitment services across Ireland.
2. Acceptance of These Terms
By accessing our website (www.purecarehealthcare.ie), submitting an application, registering as a Candidate, or engaging our services as a Client, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our app, services or website.
3. Definitions
Candidate
– any individual who registers with us or applies for temporary work through us.
Client– any organisation, healthcare facility, or individual that engages us to supply temporary staff.
Assignment– a temporary placement of a Candidate with a Client.
Services– the supply of temporary healthcare workers and related recruitment services.
Website– www.purecarehealthcare.ie and all related pages.
4. Our Services
4.1 We act as an employment business under Irish law, supplying temporary healthcare workers (including but not limited to nurses, healthcare assistants, social care workers, and support workers) to Clients.
4.2 All placements we make are temporary in nature.
4.3 We do not guarantee ongoing work, specific hours, or any particular Assignment.
4.4 All Assignments are subject to satisfactory references, Garda vetting (where required), professional registration (where applicable), and confirmation of the Candidate's right to work in Ireland.
5. Candidates
5.1 No fees charged to Candidates Purecare Healthcare Limited never charges Candidates any fees for registration, job applications, or placement. Any request for payment from someone claiming to represent us is fraudulent. Report it immediately to info@purecarehealthcare.com.
5.2 Candidates must provide accurate, complete, and up-to-date information at all times.
5.3 Candidates must have the legal right to work in Ireland and hold any required professional qualifications and registrations.
5.4 Candidates authorize us to verify information, contact referees, carry out necessary checks, and share relevant details with potential Clients for the purpose of temporary Assignments.
5.5 Candidates must notify us immediately of any change in circumstances (health, availability, right to work, professional registration, etc.) that may affect their ability to work. 5.6 While on Assignment, Candidates remain under the day-to-day supervision and direction of the Client.
6. Clients
6.1 Clients engage us to supply temporary healthcare workers. Specific commercial terms (rates, notice periods, etc.) are set out in a separate Client Agreement or Assignment confirmation.
6.2 These Terms apply in addition to any Client Agreement.
6.3 Clients must provide accurate job specifications and ensure a safe working environment that complies with all applicable health and safety and employment legislation.
6.4 Clients remain responsible for the day-to-day supervision, direction, and control of any temporary worker supplied by us.
6.5 Clients must not engage any Candidate supplied by us on a permanent or direct basis during or within a restricted period after an Assignment without our prior written agreement and payment of any applicable transfer or introduction fee (as set out in the Client Agreement).
7. Fees and Payment (Clients only)
7.1 Fees for temporary Assignments are charged on an hourly or daily rate basis (plus VAT where applicable) as agreed in the Client Agreement or Assignment confirmation.
7.2 Payment terms are as stated in the Client Agreement (typically 14 or 30 days from invoice date). Late payments may attract interest under the European Communities (Late Payment in Commercial Transactions) Regulations 2012.
7.3 We reserve the right to suspend the supply of workers if invoices remain unpaid.
8. Liability and Indemnity
8.1 We take reasonable care in the selection and introduction of Candidates. However, we do not accept liability for:
- the acts, omissions, performance, or conduct of any Candidate once placed on Assignment;
- any loss arising from a Client's decision to engage or not engage a Candidate;
- any indirect, consequential, or economic loss.
8.2 Our total liability to any Client in respect of any claim arising from our Services shall not exceed the total fees paid by that Client to us in the 12 months preceding the claim.
8.3 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under Irish law.
8.4 Clients agree to indemnify and hold us harmless against any claims, losses, or costs arising from their engagement of a Candidate or their breach of these Terms or any Client Agreement.
9. Confidentiality
Both parties agree to keep confidential all information received from the other party in connection with the Services, except where disclosure is required by law or with prior written consent.
10. Data Protection
10.1 We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Data Protection Acts 1988–2018.
10.2 Our Privacy Policy (available on our website) explains how we collect, use, and protect personal data.
10.3 Candidates and Clients acknowledge that we may share necessary personal data with each other and with third parties (e.g. for Garda vetting, reference checks, or payroll) in order to provide the Services.
11. Intellectual Property
All content on our website is owned by or licensed to Purecare Healthcare Limited and is protected by Irish and international copyright and trademark laws. You may not copy, reproduce, or use it without our prior written consent.
12. Website Use
12.1 You must not use the Website for any unlawful purpose or in any way that may damage, disable, or impair the Website.
12.2 We do not guarantee that the Website will be uninterrupted, error-free, or free from viruses. 12.3 We may update or withdraw content at any time without notice.
13. Termination
13.1 We may suspend or terminate a Candidate's registration or a Client relationship immediately if there is a material breach of these Terms or if we reasonably believe continued engagement would be unlawful or harmful.
13.2 Either party may terminate an ongoing Assignment in accordance with the notice periods set out in the relevant Client Agreement or Assignment confirmation.
14. Governing Law and Jurisdiction
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of Ireland. The courts of Ireland shall have exclusive jurisdiction.
15. General
15.1 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
15.2 These Terms constitute the entire agreement between you and us regarding the subject matter (except any signed Client Agreement).
15.3 We may update these Terms from time to time. The version published on the Website is the current version. Continued use of our Services after changes constitutes acceptance of the updated Terms.
15.4 No waiver of any breach shall be deemed a waiver of any subsequent breach.
